Getting Divorce

My boyfriend and I living together for almost 9 years.. we got two children and he manage to get their dependents visa coz he's a resident here in HK.. Our problem is we want to get marry here in HK but he's married to his separated wife and they were annulled in 2006 in the Philippines where they got married and his ex-wife is living together with somebody else too here in HK. My question is do he need to divorce his ex-wife here in Hk even if they were already annulled in the Philippines?

If the marriage has been annulled in the court of law, both parties are considered single and are never entered into that particular marriage. No marriage was ever established in the legal sense. Why would a divorce be needed???

if the marriage was annulled a so called "decree absolute" must have been issued by the court; that is proof that he is legally divorced and can enter into a second marriage if he so wishes
if he wants to re-marry he would have to present to the marriage registration office the original of such decree in order to proceed further
why don't you simply call the immigration department and find out exactly what the requisites are in hong kong to get married to a divorced person?

Be very careful when it comes to interpreting PH law. I think the word 'annulled' has a different meaning than it does in a lot of western countries. In PH there is no such thing a divorce (as 'we' know it), so a marriage may be annulled. To me it sounds the same as a divorce, but I wonder how a marriage with children can ben annulled after a number of years. Like I said, be very careful. Get expert advice.

Hello Jen, I think if their marriage is annulled in the Philippines, both of them are free to re- marry . In Hk, if you apply for marriage license, the officer will ask your single certificate from your own country and your bf, if he is divorce. If your bf has annulment certificate, then he can show this to prove that his previous marriage from Philippines was annulled. You can phone the marriage registry if you have any doubts.

If the marriage was annuled, it will be reflected on the marriage contract, usually noted at the edge of the document.
Assuming you both have to obtain permission to get married in the embassy here in HK, it is a required document plus the annotated court decision authenticated both by NSO and Office of the President.
If you are single, a document from the NSO certifying you have never entered into marriage with anyone from age 18 I think up to the present is required, also both auntenticated of course.
Does your children use your surname or your partner, legitimation procedure and other related documentation needed.
